SPRING IS IN THE AIR CONTEST
The Spring is in the Air Contest (The “Contest”) is operated and sponsored by Rolf C. Hagen Inc. (The “Sponsor”).
No purchase necessary. Entrants must comply with the Contest Rules (the “Rules”), and will be deemed to have received, understood and agreed to these Rules by participating in the Contest. To be eligible to win, Participants must visit the Contest page on www.fluvalaquatics.com and sign up (returning user) or register (new user). Upon completion and submission of the online entry, Participants will receive one (1) chance to win (i.e. one entry).
The Contest begins on May 1, 2019 at 9:00am (EST) and ends on June 30, 2019 at 11:59pm (EST). (The “Contest Period”). Any changes to these Rules, or cancellation of the Contest, will be posted on the Fluval Aquatics Website. (www.fluvalaquatics.com). It is the responsibility of Entrants to keep themselves informed as to any changes.
One (1) iPad (The “Prize”) (model and color at the discretion of the Sponsor), an approximate retail price of $329 USD. iPad is a registered trademark of Apple Inc.
On July 10, 2019, at 1:00pm (ET) at the Sponsor’s address, being 20500 Trans Canada Highway, Baie- D’Urfé, Quebec, Canada H9X 0A2, a random draw will be performed from among all the entries submitted during the Contest Period in order to award the Prize as set out in these Rules.
Odds that a given entry be selected at random depend on the number of eligible entries submitted during the contest period.
The Prize Winner will be contacted by the Sponsor via email within 2 working days of the draw.
Prize Winner will be selected and notified in the manner set out in these Rules. No Prize will be awarded where any Entrant has committed any form of misconduct, as determined by the Sponsor in its sole discretion.
Prize must be accepted as described in these Rules and may not be transferred to another person or substituted for another Prize, in part or as a whole.
In the event that any Prize Notification is returned as undeliverable or any Prize Winner fails to validly reply to a Prize Notification within twenty-eight (28) days, the Sponsor reserves the right to disqualify the Prize Winner and select an alternative Prize Winner.
In the event that, for reasons out of their control and unrelated to the Prize Winner, the Sponsor were unable to award the Prize as described in these Rules, the Sponsor agrees to substitute a Prize of equivalent value.
In the event that a Prize Winner is disqualified from the Contest, the Sponsor will, unless otherwise stated in these Rules, select an alternative Prize Winner in the same manner as the original Prize Winner and such selection will be subject to these same Rules.
Upon the request of the Sponsor, the potential Prize Winner may be required to return an Affidavit of Eligibility, and/or Release and Prize Acceptance Form.
Incidental expenses and all other costs and expenses which are not specifically listed as part of a Prize in these Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded Prize are solely the responsibility of the respective Prize Winner.
For the purpose of these rules, the Entrant is the person whose name appears on the Entry. Should the given Entry be eligible to win the Prize, only such person shall be awarded a Prize.
Unless otherwise stated in these Rules, the Contest is open to all Entrants where not prohibited by law, who have reached the age of majority in their respective place of residence at the time of Entry and who have Internet access and a valid e-mail account prior to the beginning of the Contest Period. The Sponsor assumes that by entering into the Contest, the parents or guardians of any Entrant who has not reached the age of majority have consented to that person’s Entry into the Contest and to the Rules. Entrants may be required to provide proof of identity, and if they are under the age of legal majority, should be able to demonstrate to the Sponsor’s satisfaction that their parent/ guardian has given their consent to such Entry.
By entering the Contest, the Entrant agrees to abide by these Rules and hereby warrants that all information submitted in the Entry is true, accurate and complete in every respect. The Sponsor reserves the right to verify any information contained in the Entry and/or the eligibility to enter the Contest.
Failure to comply with any of the conditions set forth in these Rules will result in the Entrant being disqualified.
The Sponsor’s employee(s), a representative or agent, and the persons with whom they are domiciled may not enter the Contest.
Entries must be made by the Contest closing date and in the manner set out in the Rules. Failure to do so will result in disqualification.
Where Entries are judged on artistic or other subjective criteria, the Sponsor reserves the right to set and/or amend the criteria used to judge Entries.
Entries are subject to verification by the Sponsor. Any entry found to be illegible, incomplete, altered, fraudulent, forged or mechanically reproduced, delayed or where applicable, does not feature the correct response to the mathematical skill-testing question, will automatically be declared void and will not entitle the Entrant to any Prize. All the Sponsor decisions regarding the application of the provisions of this Paragraph are final.
In the event of an attempt by any person to deliberately undermine the legitimate operation of the Contest or to otherwise cause the Contest to be incapable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or should a virus, bug or any other occurrence or cause beyond the reasonable control of the Contest Sponsor corrupt the security or proper administration of the Contest or affect the fairness, integrity, or normal operation of the Contest, the Sponsor reserves the right at its sole discretion to cancel, terminate or suspend the Contest.
Any damage to any website and/or server or attempts to undermine the legitimate operation of this Contest may be a violation of criminal and civil laws. Should such damage occur, the Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
The Entrant agrees that the Sponsor (and any third party authorized by the Sponsor) may use their Entry (whether or not it wins the Contest) for any promotional purpose (for example, placing it on the Fluval Aquatics website or on any poster, leaflet or other advertising media). The Entrant confirms that their Entry is an original that they own and have the right to license to the Sponsor the copyright and other intellectual property rights in the Entry for the purposes referred to in these Rules. The Entrant will retain ownership of copyright but agrees to give the Sponsor (and any third party authorized by the Sponsor) their irrevocable permission to use, reproduce, publish, display, transmit, copy, amend, store, sell and sublicense the Entry worldwide for such promotional purposes and for the purposes of the Contest.
The Sponsor will use any personal information provided with the Entry for the purposes of the Contest and, where consent is given, for marketing purposes, including the distribution of regular email updates or newsletters. Any personal information relating to the Entrant will be used solely by the Sponsor in accordance with applicable data protection legislation.
By entering the Contest, the Prize Winner permits the Sponsor to use his/her name, address, city, and province/state/region of residence, photograph, video, or any likeness for advertising or publicity purposes without any additional compensation.
LIMITATION OF LIABILITY & INDEMNITY:
By participating, Entrants and selected Prize Winner agree: (a) to be bound by these Rules and the decisions of the Sponsor, (b) to release and hold harmless the Sponsor, its affiliates, subsidiaries, and independent contractors, and their respective directors, officers, employees, agents and representatives including advertising and promotion agencies, from any and all liability for claims/damages including, but not limited to, claims/damages for personal injury, for property damage with respect to acceptance, possession or use or misuse of the Prize or participation in the Contest.
The decisions of the Sponsor in relation to this Contest will be final and binding on all Entrants.
The Sponsor cannot be held liable for requests that are illegible, incomplete, lost, sent to the wrong address, or late; such requests will be considered null and void.
The Rules and any dispute or claim arising out of or in connection with them or their subject matter (including the Contest), existence, negotiation, validity, termination or enforceability (including non-contractual disputes or claims) shall be governed by and construed in accordance with Canadian law.
For residents of Quebec, Canada, any litigation respecting the conduct or organization of a publicity Contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
